Terms & Conditions

1. Definitions
Agreement held between MYKID Ltd. (DBA: My Kid Atelier) registered at 20 Broadwick Street, W1F 8HT, London, United Kingdom and the Parent(s) of which these Terms are a part.
Child – A Child (or Children) occupying a place at MYKID Ltd. and belonging to the Parent(s).
Parent(s) – The Parent(s) or Parents Partner or Legal Guardian(s) of the Child or Children.

2. Obligations of MYKID Ltd.
My Kid Atelier shall:
2.1 Provide suitable premises and qualified staff for its MYKID Ltd. childcare services.
2.2 Ensure that the premises and staff comply with all relevant legal requirements.
2.3 Implement a suitable educational or/and entertainment program for the children.
2.4 Provide a warm and caring environment, based on equal opportunity.
2.5 Ensure that the childcare facility is open at the times as published, subject to unforeseen circumstances.

3. Obligations of the Parent(s)
Parent(s) or Guardian(s) shall:
3.1 Answer all questions in the application documents fully and honestly.
3.2 Pay all Fees promptly.
3.3 Provide a phone number where the Parent(s) can be reached at all times whilst the child is at My Kid Atelier.
3.4 Ensure My Kid Atelier is notified immediately should addresses and telephone numbers change.
3.5 Provide written details of any allergies, medicines or conditions that the Child may have.
3.6 Authorize the staff at My Kid Atelier to administer or permit administration of emergency treatment to the Child if they consider it necessary;
3.7 Ensure that the Child Is collected from My Kid Atelier by the Parent(s), Guardian(s) or a designated responsible adult at the time agreed.

4. Non-solicitation of staff
4.1 The parent/guardian of the child hereby agrees that during the term of this agreement, and for the period of six months following its termination (howsoever terminated), that he/she will not seek to employ, entice away or attempt to entice away from the employment of the Company any person employed by the Company at the date of termination of this agreement or any person who was employed by the Company in the six months preceding the date of termination of this agreement.
4.2 If, notwithstanding the provisions of clause 4.1, the parent/guardian employs, entices away or attempts to entice away any person as herein described, then he/she shall indemnify the Company in respect of all costs incurred by the Company as a result of the breach- to include but nor limited to the cost of replacing the said member of staff, agency fees for cover staff, advertising costs, management time for recruitment and selection and all such other costs reasonably and necessarily incurred by the Company in replacing the member of staff together with all legal costs and disbursements. A minimum fee of £2000 will be payable to the Company by the parent/guardian on account of these fees.

5. The Children
5.1 My Kid Atelier may insist that the Child or Children are removed from the childcare facility in the event that:
5.1.1 The child requires medical care or attention, which is not available, or that the Parent(s) refuse to permit
5.1.2 The manager at My Kid Atelier believes that the child has a contagious disease, which may endanger the health of the other Children.
5.2 No Fees shall be refunded to the Parent(s) in the event that the Child is removed from My Kid Atelier for, but not exclusive to, any of the reasons given in 4.1, unless the Child is removed permanently.

6. Fees
6.1 Spring Term (Monday, January 5th – Sunday, April 5th 2015)
Music Together: 12 classes – £210.00; Art Class: 12 classes – £250.00; Drama: 12 classes – £250.00; Stay & Play: 90 min – £12.00; Special Events on Weekends – £20.00; Siblings Discount: 50%. Registration is FREE. The Fee should be paid upfront.
6.2 My Kid Atelier reserves the right not to admit any Child if the Parent(s) have not paid the Place Fees due.
6.3 My Kid Atelier reserves the right to increase the Place Fees giving one month written notice.

7. Changes to the Agreement
7.1 My Kid Atelier reserves the right to terminate or change the Agreement giving written notice to the Parent(s) should the Parent(s) fail repeatedly to pay Place Fees on time.
7.2 Either party has the right to terminate or change the Agreement giving the other party written notice of one full calendar month.
7.4 Should either party be In breach of the Agreement, the other party can serve seven day’s written notice of termination or change, providing details of the breach of Agreement.
7.5. The Parent(s) is obliged to pay Fees during the notice period regardless of whether the Child attends or not.

8. Responsibilities
We make every reasonable effort to ensure the safety of children in the Studio. Parents and carers are responsible for the safe entry and exit of their children and for the behavior of siblings.
8.1 Behavioral Issues
If a child becomes disruptive, destructive or dangerous to themselves, other children or staff members during the class, we will make every effort to work with parents and the child to resolve this behavior. If the behavior persist, the child in question will be asked to take a break from our classes.

9. Staff
All of our staff have significant experience of working with children and undertake professional development training. All staff members are DBS checked. We maintain a staff/child ratio of 1:5 for children under the age of seven.

10. Refund Policy
Refunds are only provided under exceptional circumstances such as change of location or in the case of injury or illness, which will prevent the child from further continuation of classes. Proof of change of location or a doctor certificate will be required in order to process the refund. Refunds are not given for classes that have already occurred. Refunds will be calculated net of any discount given and a £20 processing fee will be charged. Memberships are non refundable. In the case of a member requesting to stop attending the Term’s classes due to any other circumstances.
My Kid Atelier reserves the right to offer a Credit Option where the remaining of the balance will be available to be used within one year for any of our classes.

10. Additional Policies and Rules
Hereby Parent(s) confirmed and agreed on following policies and rules: Administering Medication Policy, Aggressive Behavior Policy, Anti-Bullying Policy, Complaints Policy, Health and Safety Policy, Illness and Accidents, Confidentiality Policy.

11. The Agreement
The Agreement and these Terms and Conditions represent the whole understanding between My Kid Atelier and the Parent(s); and shall overrule any other promises or terms and conditions, whether written or oral, expressed or implied.
